How trust sales differ from probate

A property held in a properly funded living trust generally passes outside of probate. The successor trustee has authority to sell under the terms of the trust, usually without court confirmation. That can make trust sales faster and more private than probate sales — but the trustee has a fiduciary duty to act in the beneficiaries’ best interest, document decisions, and get fair market value.
